Patna High Court CWJC No.11812 of 1996 dt.30-04-2015 2 / 2 Date: 30-04-2015 Heard learned counsel for the parties.

The petitioners are aggrieved by order dated 10.01.1996, passed by the Deputy Director of Consolidation (Headquarter), Bihar, Patna (Annexure-3) affirming the order dated 19.12.1989, passed by the Circle Officer in Consolidation Case No. 82 of 1988-89. In my view, the case can be disposed of on the point raised by the petitioners that Deputy Director of Consolidation (Headquarter), Bihar, Patna has no jurisdiction to exercise the power of revision under Section 3 (j) of the Ceiling Act. In the result, the impugned orders are set aside and the matter is remitted to appropriate authority (Director Consolidation) for fresh adjudication of the matter.

This application stand allowed.
