JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Marhourah P.S. Case No. 67 of 2014 registered under Section-307 & other minor sections of the Indian Penal Code . Taking into consideration that there is specific allegation against this petitioner that he caused injury on the head of informant and the nature of injury has been kept reserved, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Marhourah P.S. Case No. 67 of 2014 pending in the court of Chief Judicial Magistrate, Saran at Chapra stands rejected.

No.34001 of 2014 (2) dt.10-02-2015 2/2 However, if, the petitioner surrenders within six weeks from today in the court below and seeks regular bail and if, the injury of the informant is found simple in nature; the concerned court shall pass appropriate order on the regular bail petition of the petitioner, without being prejudiced by this order.
