Heard the parties.

Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

144 litre of liquor was recovered from an Auto Rikshaw.

Submission is that the petitioner was simply a passenger on the said vehicle. Petitioner is in custody since 05.02.2021. Petitioner has got no criminal antecedent. Prosecution report has been submitted without proper investigation of the case.

Since this is the first allegation against the petitioner under Bihar Prohibition and Excise Act, let the petitioner, above

Patna High Court CR. MISC. No.27528 of 2021(2) dt.04-10-2021 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Complain Case No.21 of 2021 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
