The petitioner apprehends his arrest in Bachhwara P.S. case No. 127 of 2017 for the offences punishable under Section 379 of the Indian Penal Code.

The informant lodged the case for theft of his motor cycle bearing registration No. BR09V-1444 against unknown. During the course of investigation, one Abhishek Kumar was apprehended for which Bachhwara P.S. case no. 138 of 2017 was registered under section 414 of the IPC. The stolen motor cycle of Bachhwara P.S. case No. 127 of 2017 was recovered from Abhishek Kumar. The name of petitioner figured in Bachhwara P.S. case No. 138 of 2017 on the basis of confessional statement

Patna High Court Cr.Misc. No.39571 of 2018 (2) dt.09-07-2018 2/2 of Abhishek Kumar. The petitioner has already been granted anticipatory bail in Bachhwara P.S. case No. 138 of 2017 vide order passed in Cr. Misc. No. 16288 of 2018. The name of petitioner surfaced in this case also on the basis of confessional statement of Abhishek Kumar.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Begusarai in connection with Bachhwara P.S. case No. 127 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
