The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code and later on converted the offences under Sections 406/409/420 of the Indian Penal Code.
The petitioner was Branch Manager of Bharat Financial Inclusion Ltd. Company. When the petitioner was going with the cash, of the company, to deposit in the Bank, the petitioner was robbed and FIR was lodged against unknown. Two persons were apprehended and from them looted cash was recovered. One of those persons had deposited the cash in the bank account of the petitioner. Hence, it was suspected that the petitioner was involved in embezzlement in collusion with other accused persons. Thereafter, confessional statement of petitioner was recorded. The
Patna High Court CR. MISC. No.16082 of 2019(2) dt.29-04-2019 2/2 petitioner has got no criminal antecedent. He is in custody since 15.01.2019.
Submission is that the accused persons from whose possession recovery of cash was made have already been allowed bail by a coordinate Bench of this Court on 16.04.2019 in Cr. Misc. No.17886 of 2019. The petitioner is ready to cooperate with the trial.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Piri Bazar P.S. Case No.5 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
