JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-03-2019 Heard learned Counsel for the parties concerned. This writ application has been filed seeking direction to the respondents to dispose of his representation relating to his claim for compensation against the land acquired for construction of National Highway under the National Highways Act, 1956 (hereinafter referred to as 'the Act'). It has been, however, stated in the supplementary affidavit subsequently filed that certain amount of compensation have been paid to the petitioner, but he has made an application for higher compensation under Section 3G(5) of the Act, which is pending before the Arbitrator.
Patna High Court CWJC No.8603 of 2016(3) dt.07-03-2019 2/2 It is not in dispute that earlier the District Land Acquisition Officer was notified as the competent authority to determine claims raised under Section 3G(5) of the Act, but presently, the Divisional Commissioners of the respected divisions have been authorised to dispose of such claims. In view of the nature of grievance, this application is disposed of with the only observation that let the proceeding before the Divisional Commissioner, in relation to the petitioner's claim for higher compensation be expeditiously disposed of within six weeks from the date of receipt/production of the copy of this order.
