This is an application for regular bail in connection with Samastipur G.R.P. (Rail) P. S. Case no. 04 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that some unknown persons fired at father of informant while he was returning from court and as a result of which he died.

It is submitted by learned counsel for the petitioner that he is innocent and not named in the F.I.R. He has falsely been implicated in this case merely on the basis of confessional statement of co-accused Md. Chand in course of investigation and except for confessional statement, no other material is there

Patna High Court Cr.Misc. No.59185 of 2017(2) dt.15-01-2018 2/2 against him. Petitioner has got no criminal antecedent and is in custody since 24.05.2017.

Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Ist Class, Samastipur, in connection with Samastipur G.R.P. (Rail) P. S. Case no. 04 of 2017. (S. Kumar, J) sudip/- U T
