JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Chauri P.S. Case No. 67 of 2014 registered for the offences punishable under Sections 307/34, 302 of the Indian Penal Code and Section 27 of the Arms Act.

No doubt, petitioner is not named in the first information report but it appears from perusal of the impugned order of learned Sessions Judge that in course of investigation, the statement of deceased was recorded and in the said statement, he named the petitioner as assailant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the

Patna High Court Cr.Misc. No.25943 of 2015 (2) dt.27-07-2015 2/2 privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Chauri P.S. Case No. 67 of 2014 pending in the court of Smt. N. Sultana, Judicial Magistrate 1st Class, Arrah stands rejected.
