The petitioner apprehends his arrest in Warisaliganj P.S. Case No.321 of 2020, registered for the offences punishable under Sections 341, 323, 307, 385, 379, 324, 504, 506 and 34 of the Indian Penal Code.

The petitioner and other co-accused persons is alleged to have assaulted the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. It is submitted that the specific allegation is against co-accused, Raushan Kumar who assaulted the informant with rod on his head.

Patna High Court CR. MISC. No.27053 of 2021(2) dt.22-12-2021 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that due to assault the informant sustained injuries.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner is directed to surrender before the learned court below within four weeks from today and the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced from the order of this Court.
