The petitioner seeks bail in S.T. No. 465 of 2016 [arising out of Sanokhar (Amdanda O.P.) P.S. Case No. 72 of 2015] registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Informant in his fardbeyan has stated that he had gone to the house of his in-laws when on 07.07.2015, he was informed that his mother has been killed and he reached his residence on 08.07.2015, and found that his mother has been killed by firearm and thereafter named four persons including the petitioner.

It has been submitted on behalf of the petitioner that out of four named accused persons two have already been

No.39727 of 2018(2) dt.11-07-2018 2/2 granted anticipatory bail by a co-ordinate bench of this Court vide order dated 03.03.2016 passed in Criminal Miscellaneous No. 47244 of 2015 which has been annexed as Annexure-2. It has further been submitted that the petitioner has been falsely implicated in this case. Petitioner has got no criminal antecedent and is in custody since 01.02.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Bhagalpur, in connection with S.T. No. 465 of 2016 [arising out of Sanokhar (Amdanda O.P.) P.S. Case No. 72 of 2015].
