JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 1062/2014 for the offences instituted under Sections 498(A) of the I.P.C. and 4 of the D. P. Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the complainant was married with this petitioner, in which, her parents gave ornaments and other articles. After some time, her husband and other in-laws started demanding motorcycle and cash of Rs. 50,000/- and on non-fulfilment of the same they started torture and cruelty in various ways. During passage of time the complainant

Patna High Court Cr.Misc. No.26205 of 2015 (2) dt.17-07-2015 2/3 was blessed with a female child then the petitioner and other inlaws started demanding Rs. One Lac and due to non-fulfilment of the same the accused persons refused to keep her and ousted her from the matrimonial home.

It has been submitted on behalf of the petitioner that the petitioner is ready to keep the complainant with all dignity and respect but the same is not acceptable to her. Further it is submitted that the petitioner has got no criminal antecedent. Further it is submitted that the petitioner is ready to deposit amount of Rs. 2000/- per month in the court below which may be released in favour of the complainant.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit amount of Rs. 2000/- per month in the court below which shall be released in favour of the complainant and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1062 of 2014, Tr. No. 4520 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the
