The petitioner seeks regular bail in connection with Ganga Bridge P.S. Case No.105 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 427 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation as per written report submitted before S.H.O., Ganga Bridge Police Station, Vaishali is that altogether 13 F.I.R. named persons along with 15 to 20 unknown armed with deadly weapon came at the place of informant and started assaulting the informant and his family members. It is further alleged that this petitioner and two others shot fire on the buttock of Alok Singh. It is further alleged that accused Raju Kumar cut
Patna High Court Cr.Misc. No.57196 of 2017 (2) dt.13-12-2017 the hand of Alok Singh and other accused also caused injury to Fudena Singh and Binod Singh. The learned counsel for the petitioner submits that on account of land dispute the petitioner has been implicated in the present case. It is alleged that this petitioner shot fire on the buttock of Alok Singh but the doctor has not opined any fire arm injury on Alok Singh rather Alok Singh sustained simple injury caused by sharp cut and hard blunt substance. The other injured Fudena Singh sustained lacerated injury caused by hard and blunt substance. The third injured Binod Singh sustained two injuries caused by sharp cut and hard blunt substance. The petitioner is in custody since 28.08.2017 having clean antecedent.
The learned counsel for the informant opposed the submission and prayed to call for case diary for better appreciation.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S.
