The petitioner is languishing in custody since 29.11.2018 in a case registered for the offences punishable under Sections 419,420,467,468 and 471 of the I.P.C.

The prosecution case is that co-accused Mithilesh Kumar and the petitioner got a room booked in Mona Hotel on the basis of Aadhar Card issued in the name of Abdul Samad. Later on, both the accused persons left the hotel saying that they will return by 3.00 A.M. but they did not return.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been roped in the present case, and the investigation has already been concluded and there is no accusation that the petitioner committed any offence. Learned APP submits that the thrust of accusation is against the petitioner.

No.16222 of 2019(2) dt.15-03-2019 2/2 Considering the nature of accusation, the fact that the investigation has already been concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Araria P.S. Case No.715 of 2018.
