Patna High Court CWJC No.5156 of 2022(2) dt.13-05-2022 2/3 where under construction of building of Anganwadi Centres has been directed to stop and further Circle Officer, Khagaria has been directed not to pay any amount to the contractor with regard to construction of aforesaid building in question.

(ii) For issuance of any appropriate writ or writs, rule or direction, directing the respondents to allow the petitioner to complete the construction of building of Anganwadi Centre No. 234 at the village - Olapur Gangaur which is already completed linter levelled and pay the due amount as per the agreement to the petitioner.

(iii) For issuance of any appropriate writ or writs, rule or direction as your lordship may deem fit and proper to the facts and circumstances of the case as well as for which the petitioner may be found entitled there too." After the matter was heard for some time, finding the Court not in favour of the submissions made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petitioner is permitted to withdraw the present petition, with liberty to initiate appropriate proceedings before the appropriate forum and to take recourse to such other alternate remedies which are equally efficacious in law.
