Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under Section 302 read with 34 of the Indian Penal Code .

The petitioner and co-accused persons are alleged to have committed murder of the daughter of the informant due to non-fulfillment of motorcycle as dowry.

Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Learned

counsel for the petitioner has further submitted that the petitioner has informed the informant regarding the death of Kanchan Kumar. The petitioner is husband of the deceased who solemnized his marriage with the deceased about 12 years back and during that period there was no complaint against the petitioner. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. There is general and omnibus allegation against the petitioner. No dowry was demanded by the petitioner in any way. The co-accused person has already been granted bail by Coordinate Bench of this Court vide Order dated 25.10.2021 passed in Cr. Misc. No. 41717 of 2021. The petitioner is languishing in jail custody since 21.06.2020. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge- III, Danapur, Patna, in connection with Bikram P.S. Case No. 193 of 2020.

The application stands allowed.
