JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 307 and 354/34 of the Indian Penal Code, section 27 of the Arms Act and sections 3 and 4 of Explosive Substances Act. It is alleged that the accused persons used explosives and fire arms on the police officials. Name of the petitioner sprang up on the statement of co accused.

It is submitted by the learned counsel for the petitioner that no injury was caused to any police personnel and the petitioner has been maliciously roped in the present case and other case has been lodged by the police for the same incident levelling accusation under sections 399/402 IPC, sections 25(1-B),26 and 35 of the Arms Act and

Patna High Court Cr.Misc. No.27255 of 2015 (2) dt.22-07-2015 2/2 sections 3 and 4 of Explosive Substances Act. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Bhagwanpur P.S. Case No. 192 of 2014 pending in the court of learned CJM, Siwan.

This application is disposed of with the aforesaid observation/direction.
