JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2020 Heard Mr. Rajiv Kumar, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Town P.S. Case No. 45 of 2020 dated 14.01.2020 instituted for the offences under Sections 30(a), 36 and 41 of the Bihar Prohibition and Excise Act, 2016.

It appears that 42.66 litres of liquor has been recovered from a place where there was an electric meter installed in the name of one Ranjeeta Sahu. However, the petitioner is sought to be prosecuted in this case on the statement made by the neighbours that the place of recovery belongs to the petitioner.

The petitioner vehemently denies the

Patna High Court CR. MISC. No.14941 of 2020(2) dt.29-06-2020 2/2 aforesaid assertion of the local people and submits that the place of recovery belongs to Ranjeeta Sahu and not to the petitioner.

Regard being had to the aforestated facts and the clean antecedent of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Town P.S. Case No. 45 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
