The petitioner seeks bail in connection with Barachatti P.S. Case No. 38 of 2018 registered under Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act 2016. 40 lts. of country made liquor, 30 kg. mahua flower and some utensils are said to have been recovered from the house of the petitioner.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. She has no concern with the seized articles. The house from where the aforesaid articles are said to have been recovered, is inhabited by several other
Patna High Court Cr.Misc. No.41993 of 2018(2) dt.12-07-2018 2/2 family members of the petitioner and she had no knowledge of keeping of articles in the said house. She was not apprehended on the spot. She happens to be lady. She has no criminal antecedent. She has been languishing in custody since 15.05.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Barachatti P.S. Case No. 38 of 2018.
