JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 This is an application for grant of anticipatory bail in connection with Chandi P.S. Case No. 379 of 2018, disclosing offences under Sections 341, 323, 498A, 504, 506 and 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.

Allegation per the written report filed by the opposite party no.2-wife against the petitioner, who happens to be the husband of the opposite party no.2 is that petitioner has demanded Rs.4,00,000/- and for that, torturing and assaulting her and also tried to set her on fire and also assaulted by the petitioner and other accused persons.

Submission of the learned counsel for the petitioner is that as a matter of fact, the dispute was only that the opposite

No.16421 of 2019(6) dt.15-07-2019 2/2 party no.2 wants to reside with the petitioner at his working place and now the matter has been resolved and the opposite party no.2 is residing with the petitioner at his working place. Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has also admitted the above fact that the opposite party no.2 is now residing with the petitioner at his working place and the dispute has been resolved. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Hilsa, Nalanda at Biharsharif, in connection with Chandi P.S. Case No. 379 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
