This is a petition for grant of anticipatory bail for offence under Sections 341, 323, 504 and 308/34 of the Penal Code.
Though the petitioner has been named in the first information report, but, there is specific allegation of assault on the person and the main allegation is against Sanjiv Kumar and Santosh Kumar to have assaulted the informant by lathi and danda and eight injuries have been reported, but, except injuries 4, 6 and 7 others are simple, the opinion regarding injuries 4 and 6 has been reserved and injury no. 7 is fracture of 5th matacurp bone. It has been submitted that there is no specific allegation against this petitioner and both the parties are descendants of common ancestor.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail
Patna High Court Cr.Misc. No.33258 of 2014 (2) dt.06-02-2015 2/2 bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Parwalpur P.S. Case No. 85 of 2014 to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
