Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of robbery is against nine unknown persons. Petitioner is in custody since 28.08.2018.
Submission is that nothing was recovered from possession of the petitioner nor he was ever put on Test Identification Parade during investigation which is already closed now. The only material against the petitioner is that the mechanic of the motorcycle from where the said motorcycle was recovered, stated that the petitioner had brought the said stolen motorcycle for sale.
Patna High Court CR. MISC. No.17103 of 2019(2) dt.29-04-2019 2/2 Learned counsel for the State opposed the prayer for bail on the ground of criminal antecedent of the petitioner. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Alauli Police Station Case No. 151 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
