The petitioner seeks bail in connection with Khajauli P.S. Case No. 194 of 2021 dated 22.11.2021 registered for the offence punishable under Section 392 of the Indian Penal Code. As per prosecution case, when the informant was returning after collecting money, he was intercepted by three miscreants, they snatched cash, mobile and fled away. Learned counsel for the petitioner submits that petitioner was remanded in this case from Babubarhi P.S. Case No. 225 of 2022 and nothing has been recovered from the conscious possession of the petitioner. No Test Identification Parade has been held against the petitioner and he is in jail

Patna High Court CR. MISC. No.20296 of 2023(2) dt.17-05-2023 2/2 custody since 16.11.2022. He has falsely been implicated in six other cases. Learned counsel for the petitioner has further submitted that except the confessional statement there is nothing material against the petitioner.

Learned APP appearing for the State has opposed the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Madhubani in connection with Khajauli P.S. Case No. 194 of 2021.
