2. The petitioner seeks bail in connection with Raxaul P.S. Case No. 526 of 2025, registered for the offence under Sections 317(2), 317(4), 317(5), 111(2)(b) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, on getting secret information that stolen motorcycles were kept near Baba Mathiya, Nagar Road, Raxual, the police team reached at the spot and apprehended two accused persons along with one Apache motorcycle and on interrogation, they allegedly disclosed that they were involved in the business of stolen motorcycles. On the basis of their statement, the police team

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner was not present at the spot and no incriminating article has been recovered from his conscious possession. Learned counsel submits that alleged recovery of motorcycle has been made from the possession of co-accused Ravi Kumar. He further submits that petitioner is not named in the F.I.R., rather his name has transpired in this case during the investigation on the basis of confessional statement of the co-accused Bablu Kumar. Learned counsel submits that petitioner has got three antecedents and is in custody since 11.12.2025 and he undertakes to cooperate in the investigation and trial. It is further submitted that co-accused Zaheer Alam has been granted the privilege of bail by a coordinate Bench of this Court by order dated 26.02.2026 passed in Cr. Misc. No. 10782 of 2026.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner.

6. Considering the facts and circumstances of the case

No.19663 of 2026(2) dt.25-03-2026 3/3 as well as the parity, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul, East Champaran, in connection with Raxaul P.S. Case No. 526 of 2025.
