JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Special Case No.10 of 2017, arising out of F. No. NCB/PZU/V/01/2017, a case under Sections 8/20C of the N.D.P.S Act.

The petitioner is not named in the F.I.R. He has got no criminal antecedent nor anything has been recovered from the possession of the petitioner and petitioner is in custody since 22.04.2017.

Submission is that the aforesaid is the material against the petitioner.

Considering the period already undergone by the

Patna High Court Cr.Misc. No.55092 of 2017 (4) dt.03-01-2018 P2/ petitioner and the only material against the petitioner is confessional statement, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
