The petitioner apprehends his arrest in Majhaulia P. S. Case No. 310 of 2015 under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code.

The informant alleged that the petitioner executed a sale deed of 2 Kathas 12 Dhurs land under Khata No. 141 and Kheshra No. 985 situated in the village Majhaulia with her. The petitioner also agreed to sale another land and took money from the informant, but the petitioner did not execute the sale deed. When the informant went to the land, it transpired that the petitioner had already sold the same land in favour of the other.

No.22393 of 2016 (5) dt.02-08-2016 2/3 Learned counsel for the petitioner submits that the petitioner got executed the sale deed of 4 Kathas 10 Dhurs land from Sri Mahavir Hazra in the name of Sardar Gurjit Singh, the brother of the petitioner. The petitioner again purchased one Katha 7 Dhurs of land from Smt. Rumali Devi in the year 1973. The petitioner also got 2 Kathas 3 Dhurs land by virtue of the sale deed executed in the year 1973. The petitioner further stated in Para-7 of the supplementary affidavit that he sold one Katha 7 Dhurs to Kedarnath Singh on 07.06.1996, 2 Kathas land to Rameshwar Singh on 07.06.1996, 14 Dhurs 15 Dhurkies land in favour of Jawahar Lal Sah on 22.01.2015, 2 Kathas 12 Dhurs in favour of Dr. Kaushalya Keshri (informant).

The petitioner sold the land which he purchased from different persons. But the learned counsel for the informant has submitted that the petitioner concealed two sale deeds executed by him in favour of Baidyanath Singh on 22.11.2002 and another sale deed executed in favour of Kedarnath Singh in the year 2006 by which the petitioner altogether sold about 2 Kathas and 3 Kathas 5 Dhurs land. The petitioner altogether sold about 12 Kathas land in favour of different persons whereas the total area of Khata No. 141 and Kheshra No. 985 comes to 11 Kathas 2 Dhurs.

Considering the facts aforesaid and nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. The same is rejected. (Prabhat Kumar Jha, J) Mishra/- U T
