Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under Sections 420, 406 and 120(B) of the Indian Penal Code.
As per the prosecution case, Rs. 1,88,800/- under the Yojna Part-I and Rs. 56,719 under the Yojna Part-II in Mukhyamantri Grameen Peyjal Nischay Yojna were embezzled by the President and Secretary of the said Ward. Learned counsel for the petitioner has submitted that

Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 17.12.2021. He is the secretary of the said ward.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya, in connection with Konch P.S. Case No. 09 of 2021.
The application stands allowed.
