The petitioner seeks bail in connection with Gaya Mahila P.S. Case No. 33 of 2016 for the offence under Sections 376, 313 and 34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, in the medical examination of the victim, no sign of rape and abortion has been found, which is evident from the paragraph-93 of the case diary. The petitioner has falsely been implicated in this case and he has been languishing in

Patna High Court CR. MISC. No.17183 of 2019(3) dt.22-07-2019 2/2 judicial custody since 30.11.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gaya in connection with Gaya Mahila P.S. Case No. 33 of 2016.
