JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Akbarpur P.S. No. Case No.92 of 2018, registered for offences punishable under Sections 323, 337, 341, 379/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioner is that the informant fell down from motorcycle due to disturbance created by the petitioner thereafter, the petitioner along with other accused person snatched the bag containing Rs. 1,11,000/- and some papers of company and fled away.

Submission of the learned counsel for the petitioner is that the allegation against the petitioner is false and concocted and in fact cousin brother of the informant, who is a Chairman of

Patna High Court Cr.Misc. No.42101 of 2018 (2) dt.19-07-2018 2/2 Primary Agriculture Credit Cooperative Society and the petitioner sold 100 quintals paddy to that society and when the demand of Rs 15,000/- was made, the informant brutally assaulted the petitioner for which the petitioner had lodged a complaint case No.417 of 2018. It is also submitted that the petitioner has no criminal antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders before the court below within a period of six weeks from the date of the order, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Nawada in connection with Akbarpur P.S. Case No. 92 of 2018, subject to the conditions as laid down under Section 438 ( 2) Cr.P.C. with further condition that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
