The petitioner apprehends his arrest in a case under Section 6 of the Dowry Prohibition Act.
The petitioner is the husband of the complainant. It is submitted that wife made allegation against the petitioner. It is submitted that prior to lodging of the present case, complaint case 942 of 2008 for the same occurrence and almost on similar allegation of demand of dowry and torture was lodged by the complainant. The petitioner has already been granted anticipatory bail in the said complaint case. On the other hand, learned counsel for the complainant submits that the complainant is ready to live with the husband but
Patna High Court Cr.Misc. No.27042 of 2015 (2) dt.20-07-2015 her husband is neither ready to keep her nor returned her belongings.
Considering the fact that the petitioner has already been enlarged on anticipatory bail in earlier complaint case lodged by the complainant, the petitioner, above named, in the event of his arrest or surrender in the court below within a period of four weeks from the date of receipt/production of this order, shall be released on bail in connection with Complaint Case No. 213 of 2009 on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Rohtas subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
