Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. At the very outset, it is informed that petitioner no. 3, namely, Jawahar Lal Mandal has already been arrested and accordingly, his prayer for anticipatory bail stands dismissed being infructuous.
So far as petitioners no. 1 and 2 are concerned, it is alleged that above stated petitioners had executed registered sale deed in the year 2008 in respect of their lands in favour of the complainant but later on, when complainant applied for mutation,
Patna High Court Cr.Misc. No.34243 of 2014 (2) dt.05-02-2015 it came to light that husband of both the aforesaid petitioners had already sold the above stated land to other person. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners no. 1 and 2 are ladies, let petitioners no. 1 and 2, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Saharsa in Complaint Case No. 1281 C of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
