The petitioners are apprehending their arrest in a case registered under Sections 379/34 of the Indian Penal Code. Allegation is that in CCTV footage the petitioners were seen trying to take money from the gift box of Bodhivrichh.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have been made accused due to

Patna High Court CR. MISC. No.14958 of 2020(2) dt.08-02-2021 2/2 mistake of fact. The petitioners happen to be the watchmen of the Bodhivrichh. They have been made accused in the present case due to oblique reasons. As per the F.I.R., no property whatsoever has been stolen by the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Bodh Gaya P.S. case No.21 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
