The petitioner seeks pre-arrest bail in connection with Khizar Sarai P. S. Case No. 258 of 2015 registered under Sections 302, 201 and 34 of the Indian Penal Code pending before the learned Additional Chief Judicial Magistrate, IIIrd, Gaya. Regard being had to the materials collected against the petitioner in course of investigation in a case registered under Section 302 of the Indian Penal Code as described in the impugned order dated 23.4.2016 passed by the learned Additional Sessions judge, 1st, Gaya, I am not inclined to grant him pre-arrest bail. Accordingly, his prayer for grant of pre-arrest bail is rejected. However, in case the petitioner surrenders and seeks

Patna High Court Cr.Misc. No.28857 of 2016 (2) dt.25-07-2016 2/2 bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
