====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-04-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 354, 448, 504, 506/34 of the Indian Penal Code.

3. Petitioner is alleged to have inappropriately touched the daughter of the informant during the scuffle and thus, outraged her modesty.

4. It is submitted that petitioner has falsely been implicated in this case. There is no allegation of overt act against the petitioner. Both parties are co-villagers and next door neighbours. Case and counter case. Sister-in-law of the petitioner has also lodged a case against husband of the informant. Moreover, F.I.R. has been lodge after inordinate delay of 3 days and there is no plausible explanation for the

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Aurangabad in connection with Nabinagar P. S. Case No. 444 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
