Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 120B of the Indian Penal Code and Section 30(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016.

Petitioner is driver of the truck from which huge quantity of liquor was recovered. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 12.01.2019.

Considering the facts of this case, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in

Patna High Court CR. MISC. No.19008 of 2019(2) dt.03-05-2019 2/2 connection with G.O. Excise Case No. 50 of 2019 arising out of Simri Police Station Case No. 02 of 2019, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
