The petitioner has preferred this application for grant of regular bail in a case registered under sections 341, 323, 494, 498 A, 504 and 506 of the Indian Penal Code. As per the prosecution case, the informant was married to the petitioner as per Hindu rites and custom in the year 2002 and she along with her children and husband was residing in Chandigarh. The petitioner contracted second marriage during lockdown. Thereafter, the petitioner abused and assaulted the informant and she was outset from the matrimonial

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is the husband of the informant. The petitioner is in custody since 20.09.2021. Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Shivsagar ( Baddi O.P.) P.S. Case No. 327 of 2020.
The application stands allowed.
