2. The petitioner seeks bail in Patarghat P.S. Case No. 104 of 2025 registered for the offences punishable under Sections 103(1) and 61(2) of BNS 2023.

3. The allegation is that the mother of the deceased has lodged the case claiming that her daughter-in-law along with the petitioner and others has killed her son.

4. Learned counsel for the petitioner submits that the informant is not an eye-witness to the occurrence. There is no direct evidence against the petitioner. Moreover, the postmortem report shows the cause of death to be asphyxia due to hanging.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering that there is no eye-witness to the

Patna High Court CR. MISC. No.16733 of 2026(4) dt.07-05-2026 2/2 occurrence and the petitioner is in custody since 03.09.2025 having no criminal antecedent, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Patarghat P.S. Case No. 104 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
