JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 384, 307, 324 of the Indian Penal Code and Section 27 of the Arms Act.
Earlier petitioner was granted privilege of bail by this Court vide order dated 08.10.2013 passed in Cr. Misc. No. 33006 of 2013 and pursuant to that order he furnished bail bond before the court below and accordingly, he was released but from perusal of the impugned order, it would appear that petitioner failed to appear before the trial court when the case of the petitioner was running for prosecution evidence. No.22056 of 2016 (2) dt.17-08-2016 2/2 custody by the court in connection with another case and unfortunately, the Pairvikar of the petitioner did not give any information regarding the custody of the petitioner to the court below as a result whereof, the bail bond of the petitioner was cancelled on 03.12.2013. It is further submitted that when petitioner got acquitted in another case, he came to know that his bail bond in the present case has been cancelled and thereafter petitioner was remanded in this case on 01.03.2016 and since then he is languishing in jail custody.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Sessions Trial No. 369 of 2013 arising out of Asarganj P.S.
