Deceased Rajiv Bhagat was shot at by unknown three criminals and for that, informant, his father had filed written report on the basis of which, instant F.I.R. has been registered against unknown.

During course of investigation, the witnesses have disclosed that there was rumour floating in the village with regard to illicit relationship in between wife of the petitioner with the deceased and in the aforesaid background, petitioner happens to be instrumental in killing of the deceased.

On account of absence of linking in between, petitioner, Mithlesh Kumar Sharma is directed to be released on

Patna High Court Cr.Misc.
