JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 The petitioner seeks bail in connection with Sessions Trial No. 244 of 2017 arising out of Kasimbazar P.S. Case No. 153 of 2016 dated 14.11.2016 instituted for the offences under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Nineteen persons have been named in the F.I.R who are alleged to have opened fire at the deceased, killing him. No specific allegation has been levelled against anybody and it has also come during the investigation that the deceased was a person of very bad antecedent and had about twenty two (22) cases to his credit.

The learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.39599 of 2018 (2) dt.09-07-2018 2/2 that the possibility of the deceased having been killed at the hands of his sworn enemies cannot be ruled out. Because the petitioner had prior litigation with the deceased and the informant, he too has been named in the F.I.R. Be that as it may, learned counsel for the petitioner has submitted that despite the petitioner having remained in jail since 22.11.2016, even the charges in this case have not yet been framed. Taking this into account, some of the accused persons have been granted bail by a Bench of this Court.

The petitioner does not have any criminal antecedent. For the period of custody of the petitioner and the fact that the charges have yet not been framed, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 1st, Munger in connection with Sessions Trial No. 244 of 2017, arising out of Kasim Bazar P.S. Case No. 153 of 2016.
