2. The petitioners apprehend arrest in connection with Baghail P.S. Case No. 19 of 2025 instituted under Section 30(a)(c) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the prosecution case, there is recovery of 40 litres of country made liquor from the open filed. The name of the petitioners have come on secret information.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in
Patna High Court CR. MISC. No.16186 of 2025(2) dt.02-04-2025 2/3 this case. Nothing has been recovered from the conscious possession of the petitioners and the petitioners have no concern either with the seized liquor or from place of recovery. The petitioners claim clean antecedents.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Court No. 1, Rohtas at Sasaram in connection with Baghaila P.S. Case No. 19 of 2025, subject to the conditions laid down in Section 482 of the BNSS.
7. At the time of accepting bail bonds of the petitioners, the Court below will verify the criminal antecedent of the petitioners. If it is found that the petitioners have criminal antecedent, the Court below shall not accept the bail bonds of the petitioners and if it is found that the petitioners have clean antecedent, their bail bonds shall be accepted by the Court below.

8. The petitioners will also mark attendance in Baghaila Police Station, District- Rohtas on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioners. (Sandeep Kumar, J) P. Kumar U T
