JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is in custody since 27.01.2020 and has clean antecedents, seeks bail in connection with Pandaul P. S. Case No. 17 of 2020 dated 26.01.2020, corresponding to G.R. No. 147 of 2020, instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a), 36, 38(a), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Approximately 225.600 ml of foreign liquor is said to have been recovered from the possession of the petitioner. The aforesaid recovery is denied by the petitioner and it has been submitted that his implication

Considering the clean antecedents of the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Excise Act, Madhubani in connection with Pandaul P. S. Case No. 17 of 2020 dated 26.01.2020, corresponding to G.R. No. 147 of 2020.
