JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Petitioner being father of the husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 420, 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. It is alleged that complainant was confined in a room for three days without food and she was forced to file matrimonial suit for divorce.
It is submitted by learned counsel for the petitioner that thrust of accusation is against the husband of the complainant and the petitioner claims to be separate from
Patna High Court Cr.Misc. No.23610 of 2016 (2) dt.26-05-2016 2/2 the husband of the complainant.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Complaint Case No. 854(C) of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
