JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-12-2017 The petitioner seeks bail in connection with Sessions Trial No. 102 of 2017, arising out of Brahampur P.S. Case No. 144 of 2016 dated 19.07.2016 instituted for the offences under Sections 341, 323, 324, 302, 34 of the Indian Penal Code. The F.I.R. indicates that the petitioner gave a knife blow to the deceased leading to his death. It has been argued that on the same day of lodging of the present case, another case being Brahmpur P.S. Case No. 145 of 2016 was lodged by the petitioner in which he has alleged that his knife was actually snatched away from him. Taking into account the fact that petitioner is the author of the fatal injury, this Court is not inclined to grant bail

Patna High Court Cr.Misc. No.51379 of 2017 (3) dt.05-12-2017 2/2 to the petitioner for the present.

The prayer for grant of bail to the petitioner is hereby rejected.
