Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections406, 420, 379 of the Indian Penal Code. The prosecution case as per F.I.R is that the informant who is Manager of Patliputra Automobiles, in

Patna High Court CR. MISC. No.27317 of 2021(3) dt.09-02-2022 2/3 course of stock verification found that 70 motorcycles and scooters, RC Cards and 250 batteries were missing. The informant raised a suspicion that since five Security Guards were on duty and their shifts were to be decided by the Vijay Kumar, proprietor of Royal Security Services, hence they might have stolen the aforesaid articles in connivance with this petitioner who was employee of the Patliputra Automobiles.

It is submitted by learned counsel for the petitioner that only on suspicion, the petitioner has been roped in the present case. The petitioner was an employee of the said Automobile company from July, 2014 to February, 2019, prior to lodging of the present F.I.R and only in order to grab money from the insurance company, this false case has been lodged. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

It is submitted by learned A.P.P for the State that during investigation, the accusation against the

Considering the fact that the accusation against the petitioner has been found true during investigation, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender before learned Court below within a period of four weeks from today and pray for regular bail which may be considered by the learned Court below without being prejudiced by the order of this Court.

With the aforesaid observation/direction the petition stands disposed off.
