The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307/34, 323, 324 and 341 of the Indian Penal Code.
It is alleged against the petitioner that he assaulted the informant with Iron rod. One lacerated injury of marginal size has been found on the forehead of the informant by doctor simple in nature.
It is submitted by learned counsel for the petitioner that in the background of dispute with regard to road, accusation has been levelled when there is no accusation of repeating blow. A statement has been made in paragraph no. 3 of the
Patna High Court Cr.Misc. No.33769 of 2014 (2) dt.18-02-2015 2 / 2 petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Bihta P.S. Case No. 155 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
