JUSTICE ARUN KUMAR ORAL ORDER 30-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special (Excise) Case No. 519 of 2017 arising out of Bihra P.S.Case No. 247 of 2017 registered under Sections 30(d) of the Bihar Prohibition and Excise Act, 2016 It is submitted that black molasses was being taken by one Ghanshyam Choudhary and the petitioner was only driver and he was asked to transport it.

However, FIR discloses the fact that Ghanshyam Choudhary was not in the vehicle and only petitioner disclosed that he was going to hand over the material to his shop, so prayer for bail of the petitioner at present is rejected. However, he may renew his prayer for bail after framing of charge.
