The petitioner is languishing in custody since 08.02.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged from a Magic vehicle, 240 litres of illicit Mahua liquor were recovered. The petitioner is alleged to be driver of the vehicle in question.

It is submitted by learned counsel for the petitioner that the seizure list does not bear the signature of the petitioner which does not suggest that the recovery has been made from the vehicle in question.

Learned APP submits that the recovery has been made from the Magic vehicle which was being driven by the

Patna High Court CR. MISC. No.16741 of 2019(2) dt.26-03-2019 2/2 petitioner.

Considering the fact that the seizure list does not bear the signature of the petitioner when the petitioner was apprehended from the spot, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 1430 of 2019, arising out of Maner P.S. Case No. 76 of 2019.
