Heard learned counsel for the petitioner and the 04.02.2015.
State.
Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 395 of the Penal Code for dacoity committed in the office of the Income Tax Commissioner, Assistant Director, Income Tax (Investigation) at Bhagalpur. Items taken away in dacoity is computer, files of the Department. It is submitted on behalf of the petitioner that he is a food grain merchant but not paying incometax, as such, he has hardly any interest in the computer set and the records of the Income Tax Department. It is also submitted that he has no criminal antecedent at all, which fact be verified by the court below within four weeks from the date of receipt/production of a copy of
Patna High Court Cr.Misc. No.33391 of 2014 (2) dt.04-02-2015 this order in the court below, until then no coercive steps be taken against the petitioner. In case antecedent of the petitioner is clean, he be admitted to the privilege of bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 62 of 2011, provided he surrenders in the court below within a period of four weeks from the date of receipt/production of a copy of this order in the court below.
