Mr.Md. Ataur Rahman, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 19-07-2022 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Nathnagar P.S. Case No. 570 of 2020 under sections 341, 323, 504, 506, 353, 379, 406, 420, 34 of the Indian Penal Code. The allegation in the FIR is that Sunil Yadav defrauded and in the process took away Rs. 1,34,500/- through illegal withdrawal from the account of the informant. Further allegation in the FIR is that although initially he accepted his guilt and promised to return the amount, later when the informant approached him, he abused and other associates tried to assault her.

Allegation against the petitioner is that he was also part and parcel of the second occurrence when the said abuse

The learned counsel for the petitioner submits that he has suffered a lot by being the associate of Sunil Yadav and has been remanded in this case on 27.11.2021. He further submits that he is ready to abide by all terms and conditions, if granted the privilege of bail.

Since charge-sheet stands submitted and the petitioner in this case is in custody since 27.11.2021, let the petitioner be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Bhagalpur, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 570 of 2020 subject to the following conditions: (i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his

(iv) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;

With the aforesaid observations, the bail application is allowed.
