2. These are applications for regular bail on behalf of the petitioners for the offences alleged under Sections 103(1) and 3(5) of B.N.S. 2023, registered in connection with Suppi P.S.Case No. 189 of 2024 (S.T.No.84/2025).
3. The informant Parwati Devi made allegations
Patna High Court CR. MISC. No.17570 of 2025(3) dt.13-05-2025 2/3 that 22 named accused persons, including the petitioners, committed murder of her husband by inflicting knife blows. They also assaulted Ramesh Sahni, Ranjit Ram, Bipin Kumar Yadav, Dipesh Kumar, Gautam Kumar, Ram Dutt Kumar, and Suraj Kumar when they went to rescue the deceased.
4. The learned counsels for the petitioners have submitted that the injured (the son of the deceased) is also an eye-witness. He has stated during the course of investigation that Ram Ishwar Manjhi inflicted knife blows at the chest of the deceased and Kamlesh Manjhi assaulted the deceased on his head with lathi and the petitioner Kamal Manjhi assaulted the deceased with chain. It is further submitted that the post mortem report shows that only one injury at the chest of the deceased was found which is attributed to Ram Ishwar Manjhi. No any other injury has been found on the person of the deceased.
5. On the other hand, the learned counsel for the informant and the learned APP for the State have opposed the prayer for bail by submitting that the witnesses have stated in several paragraphs of the case diary that these petitioners have also assaulted the injured and the deceased.
6. From perusal of the post mortem report, it appears that only one injury at the chest of the deceased was found
Patna High Court CR. MISC. No.17570 of 2025(3) dt.13-05-2025 3/3 which is attributed to co-accused Ram Ishwar Manjhi. The petitioner Dahaur Manjhi is in custody since 16.10.2024, whereas the petitioner Kamal Manjhi is in prison since 25.12.2024 and they are the persons of clean antecedents.
7. Considering the above facts and circumstances, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-XV/JM/concerned court, Sitamarhi in connection with Suppi P.S.Case No. 189 of 2024 (S.T.No. 84/2025), subject to the conditions that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
